1. Agreement to Terms
By accessing or using MissedNoMore ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service. These terms constitute a legally binding agreement between you and MissedNoMore.
2. Description of Service
MissedNoMore provides an AI-powered missed call text-back service designed for tradespeople and small businesses. The Service includes automated SMS responses, AI-powered lead qualification, appointment booking, quote generation, follow-up sequences, and related tools accessible through our web dashboard.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old and have the legal authority to bind your business
- One organisation account per business entity
- You are responsible for all activity that occurs under your account
4. Subscription and Payment
Billing
Subscriptions are billed monthly in advance. All prices are in Australian Dollars (AUD) unless otherwise stated. Prices are exclusive of GST where applicable.
Plan Limits
Each subscription plan includes specific limits for SMS messages, AI conversations, and team members. Usage counters reset at the start of each billing cycle. If you exceed your plan limits, the service may be restricted until the next billing cycle or until you upgrade your plan.
Cancellation
You may cancel your subscription at any time through the dashboard or by contacting us. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
Failed Payments
If a payment fails, your account will be marked as past due. We will attempt to collect payment according to Stripe's retry schedule. If payment cannot be collected, your service may be suspended.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Send spam, unsolicited messages, or marketing messages to people who have not contacted your business
- Impersonate any person or entity in automated messages
- Use the Service to harass, threaten, or abuse any person
- Attempt to bypass rate limits, security measures, or plan restrictions
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Use the Service in a way that could damage, disable, or impair our infrastructure
- Resell or redistribute the Service without our written consent
6. SMS and Telecommunications
You are responsible for ensuring that your use of the SMS features complies with all applicable telecommunications laws, including the Australian Spam Act 2003 and the Telecommunications Act 1997. Messages are only sent to numbers that have first initiated contact by calling your business number.
You acknowledge that SMS delivery is dependent on third-party carriers and Twilio, and we do not guarantee delivery of every message. Standard SMS rates may apply to your customers depending on their carrier.
7. AI-Generated Content
The Service uses artificial intelligence to generate text messages, lead qualifications, quote suggestions, and other content. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. You are responsible for reviewing AI-generated quotes and messages before they are sent to customers where the Service allows manual review.
We do not guarantee that AI-generated content will be suitable for every situation. You remain ultimately responsible for all communications sent to your customers through the Service.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You are responsible for obtaining any necessary consents from your customers for the processing of their data through our Service.
9. Intellectual Property
The Service, including its design, features, code, and documentation, is owned by MissedNoMore and protected by intellectual property laws. You retain ownership of your business data and customer information. You grant us a limited licence to process your data solely for the purpose of providing the Service.
10. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control, including third-party service outages (Twilio, Stripe, hosting providers).
11. Limitation of Liability
To the maximum extent permitted by Australian law, MissedNoMore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless MissedNoMore from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if your account remains unpaid for an extended period. Upon termination, you may request an export of your data within 30 days. After 30 days, your data may be permanently deleted.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
